On Monday 15 May, Tewkesbury Borough Council successfully prosecuted landlord, Anwar Hussain for failing to comply with the terms of a prohibition order. Mr Hussain pleaded guilty to the offence and was fined £2000. He was also ordered to pay the council’s costs of over £1100 and a victim surcharge of £170.
Following complaints from a tenant regarding their housing conditions, Tewkesbury Borough Council’s environmental health department inspected a property in Kestrel Parade and found multiple hazards. Work was needed to bring the property up to the necessary standards.
The landlord, Anwar Hussain, was contacted and agreed to carry out the work, signing a written undertaking that he would not rent the property out until the agreed tasks had been carried out. Having failed to comply with officers requests, a prohibition order was served, which prohibited the use of the premises for human habitation.
In January 2017, a warrant of entry was executed and officers entered the property with the assistance of Gloucestershire Police. Tenants were found to be living in the property and the hazards were still evident.
The magistrates felt the matter was very serious and that Mr Hussain had been deceptive with the council in order to make financial gain. The magistrates also believed that Mr Hussain had deliberately taken advantage of vulnerable residents who had learning difficulties and of individuals with language barriers.
Peter Tonge, head of community services for the council said “On behalf of our residents It is important that we remain vigilant and that we hold landlords accountable to high standards. Cases such as this are rare, but nonetheless very serious; we are pleased that that has been reflected in the sentence received by the individual”
